Regular Meeting Ely City Council – City Hall, Council Chambers

CALL TO ORDER: Mayor Novak called the meeting to order at 5:30pm.

PRESENT: Council members A.Forsman, Kess, Debeltz, Omerza, Callen, D.Forsman and Mayor Novak
ABSENT: None

APPROVAL OF MINUTES:
Debeltz/D.Forsman moved to approve the minutes from the April 4, 2017 Regular Meeting. Motion Carried Unanimously.

ADDITIONS OR OMISSIONS TO AGENDA:
Addition 10. E. 13th National Prescription Drug Take Back Day Saturday April 29th from 10am-2pm at the Ely Police Department
Addition 13.C Approve Pengal’s Basswood Trading Co. Commercial Rehab Loan for 137 E Sheridan St to do store front repair including shingles, windows, door trim for $15,000 pending receipt of proper paperwork and fees and direct Attorney Klun to work with the applicant and to proceed with the loan processing.
Items A and B were added without objection.

MAYOR’S REPORT
The Local Board of Appeal and Equalization meeting will be on April 27, 2017 at 5pm at the County Assessor’s Office at 320 E Miner’s Drive #105. Next year the meeting will be back at City Hall.

Mayor Novak stated that the vandalism at the Veterans Memorial is uncalled for. If anyone has any information on the vandalism please call the Police Department.

CONSENT AGENDA:
Motion to waive readings in entirety of all ordinances and resolutions on tonight’s agenda
Approve the Ely Jaycees Temporary Liquor Licenses for the CrapolaFest on June 23, 2017 on 1st Avenue East, the Blueberry Arts Festival on July 28, 29, 30 at Whiteside Park, the Harvest Moon Festival on September 8, 9, 10 at Whiteside Park, and the Ely Marathon on September 23, 2017 at Whiteside Park pending receipt of proper paperwork.
Debeltz/D.Forsman moved to approve Consent Agenda Items A and B. Motion Carried Unanimously.

COMMITTEE REPORTS:
Standing/Special
Debeltz/Callen moved to approve the recommendation from the Sanitation Committee to have the Spring Clean Up days Friday May 19th from 8am to 3pm and Saturday May 20th from 8am to 3pm.
Langowski stated that the G Men and the City of Ely would staff the collection site on both days. The location would be on 7th Avenue near Whiteside Park as had been done in the past. The only change from previous years will be that No tires will be accepted and identifications will be checked to ensure only City residents are using the clean up days.
A.Forsman stated that 7th Avenue will be one way to facilitate checking IDs. Traffic will enter from Harvey and exit onto Sheridan Street.
Motion Carried Unanimously.
Debeltz/A.Forsman moved to approve the recommendation from the Sanitation Committee to direct the City Attorney to draft an ordinance banning the dumping of household and hazardous waste in the city trash cans and recycling center. Violation of the ordinance would result in a $300 civil citation.
A.Forsman stated that the garbage cans would include any City owned cans and the ones leased through our provider.
Motion Carried Unanimously.

Kess/Debeltz moved to approve the recommendation from the Airport Commission to enter into new contracts with Jim Preblich dba J&A Enterprises as Fixed Bases Operator (FBO) and Operations Services Agreement (OSP) with the change in the FBO Agreement Section 2.A Fuel Sales to read that the flowage fee for Jet Fuel Only be $.75 per gallon.
Kess stated that at the Airport Commission meeting they discussed the revenue of the operator and that the contracts stayed the same accept changing the FBO’s Jet Fuel flowage fuel to $.75 per gallon, it was $.50 before.
Motion Carried Unanimously.

Kess/D.Forsman moved to accept the recommendation from the Airport Commission to authorize the City Attorney to contact the USFS to draft lease for pump house, control wire and pipe placed on city property for firefighting.
Kess stated that this will formalize the City’s relationship with the USFS that has happened overtime.
Motion Carried Unanimously.

Debeltz/Callen moved to accept the recommendation from the Planning and Zoning Commission to revise the Policies for the Planning Commission and Board of Adjustment and remove item (d) from the policies. Motion Carried Unanimously.

Debeltz/Callen moved to accept the recommendation from Planning & Zoning Commission to prepare Ordinance 311, 2nd Series Digital Message Board for a first reading. Motion Carried Unanimously.

DEPARTMENTAL REPORTS:

EUC CONSENT AGENDA ITEMS: The following items of business were recommended for approval at the regular EUC meeting of Wednesday, April 12, 2017:
Approved the MDH Project Priority List.
Approved the purchase of 18 AMI A-base electric meters from Cannon Technologies for $3,053.57.
Approved the purchase of 420 bolts for the Sheridan Street lights from Fastenal for $4,368.91.
Approved payment of the Minnesota Power February bill for $269,282.91 and the March bill for $268,056.68.
Approved payment of the February EUC Bills List for $403,644.29.
Approved payment of Copperhead Invoice #11026 for $4,000.00 for a water line locator.
Debeltz/D.Forsman moved to approve the EUC Consent Agenda items 1-6 from the April 12, 2017 EUC Meeting. Motion Carried Unanimously.

Appraisals from Lots 12-15, Block 14 of Auditors Plat of Chandler Addition and Lots 23-30, Block 14 of Auditors Plat of Chandler Addition
Langowski stated that Lots 23-30, Block 14 of Auditors Plat of Chandler Addition were appraised at $10,000 and Lots 12-15, Block 14 of Auditors Plat of Chandler Addition were appraised at $6000. Langowski stated that lots 23-30 have a little better access to utilities and lots 12-15 have ledge rock on the property. Langowski will work with the property owner and potential owner.

Fire Chief

Library Director
Library Director Heinrich gave an update of the upcoming events at the library which can be located on the Library website.

Police Chief
Chief Lahtonen stated that the Prescription Drug Take Back Day will be on Saturday April 29, 2017 from 10am–2 pm at the Ely Police Station. City Hall also has a Take it to the Box Container to dispose of Prescription Drugs during City Hall Hours.

City Attorney
Lease/Concession for Heavy Metal Hockey
Kess/Omerza moved to approve the Lease Agreement between the City of Ely and Heavy Metal Sports to rent non-motorized equipment and operate concessions at Semer’s Park.
Attorney Klun stated that this is a 4.5 month lease and will include the land on the east side of the dock at Semer’s for $60 per month.
Motion Carried Unanimously.

Rehab Loan E. Sheridan Properties, LLC
Debeltz/D.Forsman moved to approve the Note and Mortgage for E. Sheridan Properties LLC for a Commercial Rehab Loan for the Folk School. Motion Carried Unanimously.

Debeltz/D.Forsman moved to approve the City and EUC claims for April 18, 2017 for $379,795.29. Motion Carried Unanimously.

A.Forsman/Debeltz moved to approve Resolution 2017-012 Authorizing the Local Board of Powers to be Reinstated Roll Called: A.Forsman-Yes, Kess-Yes, Debeltz-Yes, Omerza-Yes, Callen-Yes, D.Forsman-Yes, Mayor Novak-Yes Motion Carried Unanimously.

D.Forsman/Debeltz moved to approve Pengal’s Basswood Trading Co. OPEN FORUM

COMMITTEE REPORTS
Mayor Novak reported that the new Ambulance is coming in June and that the Ambulance Board is accelerating the need for a new garage.
Mayor Novak reported that the Canoe Festival is in need of volunteers and they are looking at having family races at the Canoe Festival this year.

A.Forsman congratulated Tom Coombe and the Ely Baseball Association for receiving the Bob Cary Spirit Award at the Smile You’re in Ely Banquet.

Omerza reported that the library inventory was one of the smoothest run inventories according to the Arrowhead Library.

Callen reported that the Gardner Trust Board met and reviewed the Spring Grant Applications.
