ORDER TO SHOW CAUSE

In the Matter of the Petition of National Bank of Commerce in Relation to Certificate of Title No. 331682 issued for land in the County of St. Louis and State of Minnesota.

TO: The Unknown Heirs of John W. Bodin, Todd Halvorson, Barbara Richards and Occupants.

A Petition and Report of Examiner of Titles are filed in the above entitled case, brought under Minnesota Statutes Chapter 508. You were identified in the Petition or the Report of Examiner of Titles as a party who may have an interest in the above-described land affected by the Order below. If you object to entry of the Order, you must show cause, if there is any, why this Court should not enter the Order. To object to entry of the Order, you must file an Answer, and pay the filing fee or obtain an order waiving the filing fee, by September 9, 2022 (“the deadline.”) No response or action is required if you have no objection to the Order. If you do not file an Answer, the Order may issue with no further notice to you.

ORDER:

1. IT IS HEREBY ORDERED that pursuant to Minn. Stat. Chapter 508, Document Nos. 530272, 548987, and 682722 are hereby reformed to provide the correct legal description as referenced in Certificate of Title No. 331682 and to provide the correct name of the Grantee/Purchaser.

2. IT IS HEREBY ORDERED that pursuant to Minn. Stat. Chapter 508 and §508.67, subd. 2, Country Lanes-North, Inc., a Minnesota corporation is now the owner in fee simple of the following described land situated in the County of St. Louis and State of Minnesota, to-wit:

Part of Lot 2, Block 1, EXCEPT that part described as follows: Beginning at the SE’ly corner of said Lot 2; thence in a W’ly direction along the South line of said Lot 2 a distance of 200 feet to a point on the E’ly boundary line of Burning Tree Road as said E’ly line of said Burning Tree Road is shown on the Plat of VILLAGE MALL; thence in a N’ly direction along said E’ly line of Burning Tree Road a distance of 131.64 feet to a point; thence continuing on the E’ly line of Burning Tree Road a distance of 63.22 feet to a point; thence in an E’ly direction a distance of 184 feet more or less to a point on the E’ly boundary line of said Lot 2 which point is a distance of 194 feet North from the point of beginning; thence in a S’ly direction along the E’ly boundary line of said Lot 2 to the point of beginning, all in VILLAGE MALL, according the recorded plat thereof.
Except all minerals and mineral rights.

3. IT IS HEREBY FURTHER ORDERED that the St. Louis County Registrar of Titles shall cancel Certificate of Title No. 331682 and issue in lieu thereof the following certificates of title:

a. A new Certificate of Title showing Country Lanes-North, Inc., a Minnesota corporation, to be the owner in fee simple of the following:

Part of Lot 2, Block 1, EXCEPT that part described as follows: Beginning at the SE’ly corner of said Lot 2; thence in a W’ly direction along the South line of said Lot 2 a distance of 200 feet to a point on the E’ly boundary line of Burning Tree Road as said E’ly line of said Burning Tree Road is shown on the Plat of VILLAGE MALL; thence in a N’ly direction along said E’ly line of Burning Tree Road a distance of 131.64 feet to a point; thence continuing on the E’ly line of Burning Tree Road a distance of 63.22 feet to a point; thence in an E’ly direction a distance of 184 feet more or less to a point on the E’ly boundary line of said Lot 2 which point is a distance of 194 feet North from the point of beginning; thence in a S’ly direction along the E’ly boundary line of said Lot 2 to the point of beginning, all in VILLAGE MALL, according the recorded plat thereof.

EXCEPT all minerals and mineral rights

Said new Certificate of Title shall be entered subject to the following memorials: Document Nos. 315765, 364655, 372891, 373261, 373262, 821545, 836879, 1001478 and 1056224.

b. A residue Certificate of Title showing the John W. Bodin, to be the owner in fee simple of all the property showing on Certificate of Title No. 331682 subject to any and all existing rectials, EXCEPT the following:

Part of Lot 2, Block 1, EXCEPT that part described as follows: Beginning at the SE’ly corner of said Lot 2; thence in a W’ly direction along the South line of said Lot 2 a distance of 200 feet to a point on the E’ly boundary line of Burning Tree Road as said E’ly line of said Burning Tree Road is shown on the Plat of VILLAGE MALL; thence in a N’ly direction along said E’ly line of Burning Tree Road a distance of 131.64 feet to a point; thence continuing on the E’ly line of Burning Tree Road a distance of 63.22 feet to a point; thence in an E’ly direction a distance of 184 feet more or less to a point on the E’ly boundary line of said Lot 2 which point is a distance of 194 feet North from the point of beginning; thence in a S’ly direction along the E’ly boundary line of said Lot 2 to the point of beginning, all in VILLAGE MALL, according the recorded plat thereof.

Except all minerals and mineral rights:
And shall also INCLUDE the following:
ALL the MINERALS AND MINERAL RIGHTS in upon or under the following described lands to-wit:
Part of Lot 2, Block 1, EXCEPT that part described as follows: Beginning at the SE’ly corner of said Lot 2; thence in a W’ly direction along the South line of said Lot 2 a distance of 200 feet to a point on the E’ly boundary line of Burning Tree Road as said E’ly line of said Burning Tree Road is shown on the Plat of VILLAGE MALL; thence in a N’ly direction along said E’ly line of Burning Tree Road a distance of 131.64 feet to a point; thence continuing on the E’ly line of Burning Tree Road a distance of 63.22 feet to a point; thence in an E’ly direction a distance of 184 feet more or less to a point on the E’ly boundary line of said Lot 2 which point is a distance of 194 feet North from the point of beginning; thence in a S’ly direction along the E’ly boundary line of said Lot 2 to the point of beginning, all in VILLAGE MALL, according the recorded plat thereof.

Said residue Certificate of Title shall be entered subject to the following memorials: Document Nos. 315765, 364655, 372891, 373261, 373262, 432382, 476149, 476150, 476151, 530272, 542068, 821545, 836879, 1001478.

If you choose to object, your Answer must be e-filed by your attorney. If you do not have an attorney, the Answer may be filed by mailing it to: Court Administration, 100 N. 5th Ave. W., Room 320, Duluth, MN 55802, with a check payable to District Court Administrator for $300.00 for the filing fee, or with an order waiving the fee; or the Answer and check or order waiving the fee may be deposited in the District Court drop box at the same location or filed in-person at the same location if the office is open to walk-in public. IT IS FURTHER ORDERED, that a copy of this Order to Show Cause be served:

(a) at least 20 days before the deadline upon the above-named parties residing in this State in the manner provided by law for the service of Summons in a civil action;

(b) at least 20 days before the deadline upon each of the above-named nonresidents and foreign corporations, partnerships, or associations that cannot be found for service in the state, by personal service out-of-state, or in the alternative, by two weeks published notice of the Order to Show Cause and by sending a copy of this Order at least 24 days before the deadline by first class mail to the non-resident’s or foreign entity’s out-of-state post office address;

(c) upon each of the above-named parties who cannot be found by two weeks published notice of the Order to Show Cause and by sending a copy of this Order at least 24 days before the deadline by first class mail to the last known address of the party and by sending another copy of this Order at least 24 days before the deadline by first class mail to the address of such party as stated on the Certificate of Title if an address is so stated;

(d) upon a dissolved, withdrawn, or revoked business entity governed by Minn. Stat. Chapters 302A, 303, 317A, 321, 322C, or 323A in the manner provided by Minn. Stat. § 5.25 [Note: deadline date on the Order to Show Cause must be at least 30 days after date of mailing by the Secretary of State];

(e) per Title 28 USC § 2410, and Fed. R. Civ. Pro. Rule 4, the United States Government must be notified at least 60 days prior to the deadline date in the manner provided by federal law for the service of the Summons in a civil action.
