It is Ordered and Notice is given that on Sep 18, 2023, at 09:30 AM, a hearing will be held at Virginia Courthouse, 300 South 5th Avenue, Virginia Minnesota 55792, for the formal probate of an instrument purporting to be the original Will of the Decedent dated, Sep 13, 2010, (“Will”), and for the appointment of Bobbi Lynn Ellenberg, whose address is 13515 Flint Lane, Apple Valley, MN 55124 as Personal Representative of the Estate of the Decedent in an UNSUPERVISED administration. Any objections to the petition must be filed with the Court prior to or raised at the hearing. If proper and if no objections are filed or raised, the Personal Representative will be appointed with full power to administer the Estate including the power to collect all assets, to pay all legal debts, claims, taxes and expenses, to sell real and personal property, and to do all necessary acts for the Estate.
Notice is also given that (subject to Minnesota Statutes section 524.3-801) all creditors having claims against the Estate are required to present the claims to the Personal Representative or to the Court Administrator within four months after the date of this Notice or the claims will be barred.

TRAILHEAD SITE REBID
ADVERTISEMENT FOR BIDS
Sealed Bids for the construction of the site development work for the Ely Trailhead Site Rebid will be received for a single prime contract, by the City of Ely (The Owner), at the office of the Clerk, until 2:15 p.m. local time on September 14, 2023, at which time the Bids received will be publicly opened and read. The Project consists of constructing approximately 1,500 cubic yards common excavation, 1,200 cubic yards Class 5, 900 tons bituminous paving, 300 linear feet storm sewer, 6,500 square feet concrete walk, 950 linear feet curb and gutter, site landscaping and all related appurtenances.
Prospective Bidders may examine the Bidding Documents at the Issuing Office and may obtain copies of the Bidding Documents from the Issuing Office (Office of the Engineer): JPJ Engineering, Inc., P.O. Box 656, 425 Grant Street, Hibbing, MN 55746, Phone: 218- 262-5528, www.jpjeng.com
Bidding Documents also may be examined at the office of the Owner and the Minnesota Builders Exchange.
Printed copies of the Bidding Documents may be obtained from the Issuing Office upon payment of $50.00 for each set. No refund will be provided. Checks for Bidding Documents shall be payable to JPJ Engineering, Inc. Upon request and receipt of payment indicated above, the Issuing Office will transmit the Bidding Documents via U.S. mail. Partial sets of Bidding Documents will not be available from the Issuing Office. Neither Owner nor Engineer will be responsible for full or partial sets of Bidding Documents, including Addenda if any, obtained from sources other than the Issuing Office.

Bidders responding to this solicitation document shall submit to the Owner a signed statement under oath by an owner or officer verifying compliance with each of the minimum criteria in Minnesota Statutes, Section 16C.285, subdivision 3.
Bid security shall be furnished in accordance with the Instructions to Bidders, in an amount not less than 5% (five percent) of the Total Bid. The successful bidder will be required to provide a Performance Bond, Payment Bond and a Certificate of Insurance.
The Owner reserves the right to reject any or all bids, to waive irregularities and informalities and to award the contract in the best interest of the OWNER.

1.01 PROJECT INFORMATION
A. Notice to Bidders: Qualified bidders may submit bids for project as described in this Document.
Submit bids according to the Instructions to Bidders.
1. Regulatory Requirements: Applicable State and Local laws and regulations shall govern submittal, opening, and award of bids.
2. This project will be partially funded with Federal funds from the United Sates Department of Commerce, Economic Development Administration and therefore is subject to the Federal laws and regulations associated with that program.

1.02 BID SUBMITTAL AND OPENING
A. Owner will receive sealed lump sum bids until the bid time and date at the location given below.
Owner will consider bids prepared in compliance with the Instructions to Bidders issued by

2. Bid Time: 2:00 PM, local time.

1.03 BID SECURITY
A. Bid security shall be submitted with each bid in the amount of 5 percent of the bid amount. No bids may be withdrawn for a period of 60 days after opening of bids. Owner reserves the right to reject any and all bids and to waive informalities and irregularities.
1.04 PREBID MEETING
A. Prebid Meeting: A prebid meeting will not be held.
1. Bidders' Questions: Architect will provide written responses to bidders' questions received no later than September 7, 2023 at 12:00 PM local time.
2. Bidders are encouraged to review site work previously completed and other work being bid concurrently under a separate contract. Contact the Owner’s representative for Construction Documents relevant to this work.
1.05 DOCUMENTS
A. Online Procurement and Contracting Documents: Obtain access after August 18, 2023, via QuestCDN.com. Using QuestCDN number 8433428. Online access will be provided to all registered bidders and suppliers.
1.06 TIME OF COMPLETION
A. Successful bidder shall begin the Work on receipt of the Notice to Proceed and shall complete the Work within the Contract Time.
1.07 BIDDER QUALIFICATIONS
A. Bidders must be properly licensed under the laws governing their respective trades and be able to obtain insurance and bonds required for the Work. A Performance Bond, separate Labor and Material Payment Bond, and Insurance in a form acceptable to Owner will be required of the successful Bidder.
