AN INTERIM ORDINANCE TEMPORARILY PROHIBITING

SHORT TERM RENTALS OF PROPERTIES IN THE CITY

THE CITY COUNCIL OF THE CITY OF WINTON, MINNESOTA ORDAINS:

 

 

SECTION 1. Background.

 

1.01. Authority. Pursuant to Minnesota Statutes Section 462.355, Subd. 4, the City of Winton is authorized to establish interim ordinances to regulate, restrict or prohibit any use or development in all or a part of the City while the City is conducting studies, or has authorized a study to be conducted, or has scheduled a hearing to consider adoption or amendment of the comprehensive plan or official zoning controls. The City declares that this Interim Ordinance is established pursuant to the aforementioned statute.

 

1.02. Findings and Purpose. There is concern that the current Zoning Ordinance provisions or lack thereof relating to short-term rentals, do not adequately regulate issues related to the rental of properties for a period of less than 28 days. The City has initiated the study of short-term rentals within the City. The City is in the process of reviewing these studies and upon completion of this review will make the necessary revisions to the City Ordinance concerning short-term rental. As a result of the important land use and zoning issues cited above, the City Planning staff will conduct studies for the purpose consideration of possible amendments to the City’s official controls to address the issues concerning short-term rentals. The City finds that this Interim Ordinance must be adopted to protect the planning process and the health, safety, and welfare of the citizens.

 

SECTION 2. Definition. For purposes of this Ordinance, the term “short-term rental” is defined as follows:

 

The rental of any dwelling unit, home, cabin, condominium, or similar building being offered as a place where sleeping accommodations are provided to the public, whether nightly, weekly, or otherwise and for less than 28 days to the same party within the City whether that is for money or for exchange of goods or services.

 

SECTION 3. Prohibition.

 

3.01. In accordance with the findings set forth in Section 1.02 and pursuant to the authority of Minnesota Statutes, Section 462.355, Subd. 4, there is hereby established a moratorium on the rental of properties in the City of Winton for periods of less than 28 days.

 

3.02. During the effective period of this Interim Ordinance, conducting short-term rentals, or applications for a permit or any other permit for a rental shall not be accepted, considered, or approved by the City. This statute prohibits the further use, consideration, and approval of any short-term rental within the City.

 

SECTION 4. Enforcement. The City may enforce this Ordinance by injunction or any other appropriate civil remedy in any court of competent jurisdiction.

 

SECTION 5. Separability. Every section, provision or part of this Ordinance is declared separable from every section, provision, or part of this Ordinance. If any section, provision, or part of this Ordinance is adjudged to be invalid by a court of competent jurisdiction, such judgement shall not invalidate any other section, provision, or part of this Ordinance.

 

SECTION 6. Duration. This Ordinance shall take effect fifteen days after its publication and shall remain in effect until the date of adoption by the City Council of the amendments to official controls contemplated hereunder or one year, whichever occurs first.

Notice is also given that (subject to Minn. Stat. 524.3-801) all creditors having claims against the Estate are required to present the claims to the personal representative or to the Court Administrator within four months after the date of this Notice or the claims will be barred.

The Ely Police Department is currently accepting applications for the position of a full-time Patrol Officer.  Our department consists of 7 fulltime licensed peace officers and 1 administrative assistant.  Starting base salary for 2023 is $29.95, with pay increases at 6 months, 1 year, and reaching top pay at year 2 ($33.58).  Longevity steps on top of base pay at years 3 (2.5 %), 4 (3%), 5 (3.5%), 10 (3%), 15 (4%), 20 (5%), 25 (6%), and 30 (7 %).  Employees also shall receive 4 % wage shift differential for all hours worked between 3:00pm and 7:00 am.  Benefits include, health, dental, health savings, uniform allowance, 14 paid holidays, 2 personal days, vacation and sick leave.  

 

Applicants must be P.O.S.T. licensed or eligible for licensing at the time of hire.  Applicants must be a U.S. Citizen, possess a valid MN driver’s license, pass a background check, physical fitness exam, and psychologic examination prior to appointment.  To be considered, you must submit a City of Ely application and resume by Friday, September 29th, 2023.   Lateral transfers are encouraged to apply; pay and benefits may be evaluated based on years of service and experience.
