AN ORDINANCE OF THE CITY OF ELY, MINNESOTA, ADDING TO THE ELY CITY CODE, CHAPTER 20, SECTION 20.13.25, ENTITLED VACATION OF A PORTION OF CITY-OWNED PROPERTY, LOCKHART STREET AND ALLEY BETWEEN LOCKHART STREET AND VERMILLION STREET

THE COUNCIL OF THE CITY OF ELY DOES HEREBY ORDAIN:

SECTION 1. A new Section shall be added to Chapter 20 as Section 20.13.25, of the Ely City Code to read as follows:

SEC. 20.13.25 VACATION OF A PORTION OF CITY-OWNED PROPERTY. The City shall vacate the public right-of-ways described as:

that portion of Lockhart Street running directly adjacent to Lots 21 through 16 and Lots 73 through 71, Block 7, CHANDLER ADDITION TO ELY

AND

that portion of the unbuilt alleyway between Lockhart Street and Vermillion Street bounded by Lot 70 and bounded by Lots 71, 77, 78, 79, 80, and 81, Block 7, CHANDLER ADDITION TO ELY

Said parcel contains 0.35 acres.

The Ely Board of Adjustment will be holding a public hearing to consider a zoning correction for the following addresses:
233 East Chapman St., 243 East Chapman St. & 247 East Chapman St.

These properties are currently located within a residential zone and are, or will be, used commercially. Therefore, a rezone from the current Residential- (2) to the appropriate Commercial- (1) zone will be proposed.

The public hearing will occur on April 20th at 5:00pm in the City Hall Chambers.

All questions and/or comments wished to be heard at the hearing may be submitted in person at the public hearing, by mail to the Zoning Administrator at 209 E. Chapman St. Ely, MN 55731 or by email to pzadmin@ely.mn.us

Call To Order:
Mayor Skraba called the public hearing to order at 4:45pm.

PRESENT: Council members A.Forsman, Kess, Debeltz, Omerza, Callen, Campbell and Mayor Skraba
ABSENT: None

Purpose:
Ely City Council will hold a public hearing regarding Ordinance 355 2nd Series the Sale of City Land located at Lot 3, Block 1, Echo Property – Zups Parking Lot

Mayor Skraba asked if anyone from the public would like to speak regarding Ordinance 355. No one came forward to speak.

Attorney Klun indicated that the City did not receive any concerns or inquiries regarding this ordinance. This Ordinance is only for one lot, Lot 3, Lot 4 is still county owned. Attorney Klun indicated both parties have signed the Purchase Agreement and the earnest money has been paid.
